These Terms of Use (“Terms”) explain the rules for using Tera Cota, including our mobile application, website, plant identification features, plant care information, subscription features, and related services together called the “Service.”

By downloading, accessing, subscribing to, or using Tera Cota, you agree to these Terms. If you do not agree, do not use the Service.

1. What Tera Cota Does

Tera Cota helps users identify plants from photos and view plant-related information, such as plant names, descriptions, care guidance, and safety-related information.

Tera Cota is provided for general informational and educational use only.

Tera Cota is not a professional botanical, medical, veterinary, poison-control, emergency, agricultural, or legal service.

2. Important Safety Notice

Plant identification, care information, toxicity information, pet safety information, and other plant-related content may be incomplete, outdated, inaccurate, or unsuitable for your specific situation.

You should not rely on Tera Cota as your only source of information when making decisions involving:

• human health;
• pet health;
• children;
• allergies, rashes, skin irritation, or poisoning;
• whether a plant is safe to touch, eat, handle, keep indoors, or expose to pets;
• medical, veterinary, emergency, or poison-control situations;
• edible, medicinal, toxic, invasive, or dangerous plants.

Do not eat, touch, prepare, use, or give any plant to a person or animal based only on information from Tera Cota.

If you believe a person or animal may have touched, eaten, or been exposed to a harmful plant, contact a qualified doctor, veterinarian, poison-control center, or emergency service immediately.

You are responsible for independently checking plant information and making your own decisions.

3. Plant Identification and Information Accuracy

Tera Cota uses algorithms, databases, and technical systems to generate plant identification results and related plant information.

Identification results may include possible matches, probabilities, or suggestions. A result does not guarantee that the plant has been identified correctly.

Similar-looking plants may be confused with each other. Image quality, lighting, angle, plant age, season, visible plant parts, and other factors may affect results.

Tera Cota does not guarantee that any identification, plant name, classification, description, care instruction, safety warning, or other result is correct, complete, current, or suitable for your situation.

4. Plant Care and Safety Information

Tera Cota may provide care and safety-related information for some plants. Availability and depth of information may vary by plant and may change over time.

Plant care depends on many factors, including climate, season, soil, pot size, humidity, water quality, pests, cultivar, indoor conditions, and local environment.

Safety information may also vary depending on the person, animal, amount of exposure, and circumstances.

Tera Cota does not guarantee that plant care or safety information will be complete, current, accurate, or suitable for your plant, home, child, pet, or environment.

5. Subscription and Access

Tera Cota may be free to download, but access to capture and identification features may require an active paid subscription or free trial.

Current subscription options, prices, trial availability, renewal periods, and billing terms are shown in the app before purchase. Prices and offers may vary by country, currency, region, user eligibility, and time.

Subscriptions are processed through Apple’s App Store and may automatically renew unless canceled according to Apple’s rules.

You are responsible for managing and canceling your subscription through your Apple ID settings. Deleting the app does not cancel your subscription.

Refunds, billing issues, cancellations, and subscription management are generally handled by Apple, not directly by Tera Cota.

If your subscription expires or is canceled, you may lose access to capture new plants. If you previously used the app while subscribed, you may still be able to view plant history stored on your device, but you will need an active subscription to capture new plants.

6. Restore Purchases

Tera Cota may provide a “Restore Purchases” option to help restore subscription access connected to your Apple ID.

Access is usually restored automatically after a valid purchase or restore action. If access does not restore correctly, contact us at support@teracota.app and include your anonymous user ID from the app settings.

7. Unlimited Captures and Fair Use

Tera Cota may describe capture access as “unlimited.”

Unlimited captures means normal personal use, subject to fair use, technical availability, server load, abuse prevention, rate limits, and system security.

We may delay, queue, limit, reject, or temporarily disable capture requests when needed, including during high server load, technical problems, suspicious activity, automated usage, abuse, or excessive request volume.

Tera Cota is intended for personal, non-commercial use unless we separately agree otherwise in writing.

8. Photos and User Content

When you use Tera Cota, you may upload or capture photos for plant identification.

You are responsible for the photos and other content you submit. You agree not to upload content that is illegal, harmful, abusive, offensive, invasive of privacy, infringing, or unrelated to legitimate use of the Service.

You should avoid uploading photos of people, children, private documents, sensitive personal information, or anything you do not have the right to upload.

Tera Cota does not publish your uploaded photos publicly as part of the Service. However, uploaded content may be processed and stored as described in our Privacy Policy.

9. Plant History

Tera Cota may store plant history, images, and related information on your device.

If you delete the app, change devices, clear app data, or lose access to your device, your plant history may be lost. Tera Cota is not responsible for lost plant history, deleted photos, device problems, or unavailable local data.

10. Acceptable Use

You agree not to:

• use Tera Cota for illegal, harmful, abusive, or fraudulent purposes;
• use bots, scripts, automation, scraping, or high-volume systems;
• bypass, disable, or interfere with subscriptions, paywalls, rate limits, or security systems;
• reverse engineer, copy, modify, decompile, or attempt to extract the source code, models, databases, algorithms, or systems of the Service;
• attack, overload, test, scan, or interfere with our servers, infrastructure, or security systems;
• resell, redistribute, or commercially exploit the Service without permission;
• use Tera Cota to build a competing product, model, database, or service;
• upload content that violates another person’s rights;
• rely on Tera Cota for emergency, medical, veterinary, poison-control, or safety-critical decisions.

We may restrict, suspend, limit, or block access to capture functionality or the Service if we believe these Terms have been violated or if needed to protect users, the Service, or our systems.

11. Intellectual Property

Tera Cota, including the app, design, software, branding, text, databases, generated content, systems, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

You may use Tera Cota only as allowed by these Terms.

You may share ordinary screenshots or plant results for personal purposes, provided you do not misrepresent the Service, remove important warnings, violate another person’s rights, or use them commercially without permission.

Some plant images, fonts, software, data, or other materials may be provided by third parties and may be subject to their own licenses.

12. Feedback

If you send us ideas, suggestions, comments, or other feedback about Tera Cota, you allow us to use that feedback without restriction or compensation to you.

This helps us improve the Service.

13. App Store Terms

If you download Tera Cota from Apple’s App Store, your use of the app may also be subject to Apple’s applicable terms, including Apple’s App Store rules and standard licensed application terms.

Apple is not responsible for providing support or maintenance for Tera Cota, except as required by applicable law.

14. Service Availability

Tera Cota is provided on an “as is” and “as available” basis.

We do not guarantee that the Service will be uninterrupted, error-free, secure, fast, always available, or compatible with every device, region, operating system, or network.

We may modify, suspend, limit, or discontinue any part of the Service at any time.

15. No Warranties

To the maximum extent permitted by law, Tera Cota disclaims all warranties, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, and merchantability.

We do not warrant that:

• plant identification results will be correct;
• care information will be suitable for your plant;
• safety information will be complete or accurate;
• the Service will detect all dangerous, toxic, allergenic, edible, or non-edible plants;
• the Service will prevent harm to people, pets, plants, or property;
• capture requests will always be accepted or processed immediately;
• the Service will always be available or error-free.

16. Limitation of Liability

To the maximum extent permitted by law, Tera Cota and its owner, operators, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages or losses related to:

• incorrect plant identification;
• incomplete or inaccurate care or safety information;
• plant damage or plant death;
• personal injury, rash, allergy, poisoning, illness, or death;
• pet injury, illness, poisoning, or death;
• property damage;
• lost data or lost plant history;
• subscription or billing issues handled by Apple;
• inability to access or use the Service;
• server delays, queues, rate limits, or downtime;
• decisions made based on information from Tera Cota.

Your use of Tera Cota is at your own risk.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnity

You agree to defend, indemnify, and hold harmless Tera Cota from claims, damages, liabilities, losses, costs, and expenses arising from:

• your use or misuse of the Service;
• your uploaded content;
• your violation of these Terms;
• your violation of another person’s rights;
• your reliance on plant identification, care, or safety information from Tera Cota.

18. Privacy

Your use of Tera Cota is also governed by our Privacy Policy.

The Privacy Policy explains what information we collect, how we use it, and what choices you have.

19. Changes to These Terms

We may update these Terms from time to time.

When we update them, we will change the effective date above. We may also provide notice through the app, website, App Store update notes, or other reasonable methods.

Your continued use of Tera Cota after updated Terms become effective means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the United Arab Emirates, except where applicable consumer protection laws require otherwise.
